Welcome to The Americanized! These Terms of Service ("Terms") apply to your use of our online store at theamericanized.shop (the "Site") and any purchase you make from us. In these Terms, "The Americanized," "we," "us," and "our" mean The Americanized, operated by Nelio Diaz, and "you" means anyone who visits the Site or buys from us.

By using the Site or placing an order, you agree to these Terms, along with our Shipping Policy, Refund Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the Site.

1. Using the Site

- You must be at least the age of majority where you live, or use the Site with the involvement of a parent or guardian, to place an order.
- You agree to use the Site only for lawful purposes. You won't try to hack, disrupt, scrape, or misuse the Site, upload malicious code, or use it to infringe anyone's rights.
- We may refuse service, cancel orders, or restrict access to anyone at our discretion, for example in cases of suspected fraud or misuse.

2. Accounts

If you create an account, you're responsible for keeping your login details secure and for all activity under your account. Please give us accurate, current information and let us know at support@americanized.ai if you think your account has been used without permission.

3. Our store runs on Shopify

Our Site is hosted on Shopify, and payments are handled by Shopify and other payment processors. Your use of their services may also be subject to their own terms and policies.

4. Products, descriptions, and colors

Each piece is printed or stitched just for you after you order, by our fulfillment partners, Apliiq (apparel) and Printful (hats, beanies, and accessories). We do our best to describe and display our products accurately, but:

- Colors may look slightly different on your screen than in real life, depending on your device and display settings.
- Because each item is printed or embroidered individually, small variations in print placement, color, and sizing are normal.
- Product mockups and photos are for illustration and may differ slightly from the finished item.

5. Pricing, availability, and orders

- All prices are in US dollars unless shown otherwise. Shipping costs and any applicable taxes are shown at checkout.
- Prices, products, and availability can change at any time without notice. We may discontinue any product at any time.
- Placing an order is an offer to buy. We may accept or decline any order. If we cancel an order after you've been charged, we'll refund you in full.
- If we discover a clear pricing or typographical error, we may cancel the affected order and refund you, even after it's been confirmed.

6. Discount codes and promotions

Unless a promotion says otherwise: one discount code per order; codes have no cash value; codes can't be combined, transferred, or applied after purchase; and we may change or end a promotion at any time. Specific promotions may have additional terms, which will be shown with the offer.

7. Intellectual property

Everything on the Site, including designs, graphics, text, photos, and logos, belongs to The Americanized / Nelio Diaz or our licensors. This includes The Americanized name and logos, the "TA" logo, and the El Americanizado podcast name, logos, and branding, all of which belong to Nelio Diaz / The Americanized. You may not copy, reproduce, sell, or use any of our designs or branding without our written permission. Buying a product gives you ownership of that physical item, not any rights to the design or brand.

8. Feedback and reviews

If you send us comments, ideas, reviews, or other feedback, you allow us to use them without any obligation to you. Please don't post anything unlawful, abusive, or that infringes anyone's rights.

9. Third-party links

The Site may link to third-party websites (for example, podcast platforms or social media). We're not responsible for their content, products, or practices.

10. Disclaimer

Except as expressly stated in these Terms or our policies, the Site and our products are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the Site will always be available, uninterrupted, or error-free.

11. Limitation of liability

To the fullest extent permitted by law, The Americanized, Nelio Diaz, and our partners won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.

12. Indemnification

You agree to hold The Americanized and Nelio Diaz harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

13. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Nothing in these Terms limits any rights you have under the consumer protection laws of the place where you live that can't be waived by contract.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply to orders placed and use of the Site after the update is posted.

15. Severability

If any part of these Terms is found to be unenforceable, the rest will remain in effect.
